The rock-ice avalanche and flash flood in Nepal in August 2026, which destroyed critical infrastructure and wiped out nearly 10% of the country’s installed hydropower capacity, have brought climate justice, loss and damage, and international liability to the forefront.
Nepal contributes only around 0.1% of global greenhouse gas emissions, yet its Himalayan ecosystem is warming rapidly and experiencing cryospheric instability.
Nepal’s demand for climate compensation from major emitters, including the US, China and India, therefore highlights a fundamental global climate dilemma-those least responsible for climate change often face some of its most severe consequences.
For India, the issue is particularly significant because it combines the principles of CBDR-RC, regional climate vulnerability, hydropolitics and the need for greater Himalayan cooperation.
Why is Nepal Demanding Climate Justice and compensation?
- The “Third Pole” Paradox
The Hindu Kush Himalayas (HKH), often called the world’s “Third Pole”, are experiencing rapid climatic and cryospheric changes.
Nepal’s extremely low contribution to global emissions contrasts sharply with its exposure to:
- Glacier retreat
- Glacial lake outburst floods (GLOFs)
- Rock-ice avalanches
- Flash floods
- Landslides
- Changing precipitation patterns
- Water-security risks
This creates a fundamental equity problem: low-emitting countries bear disproportionately high adaptation and disaster-recovery costs.

- However, Nepal’s demand places India in a different position as a major South Asian economy, major contemporary emitter, downstream Himalayan country, and a regional development partner.
- India therefore faces the challenge of reconciling global climate equity with regional climate solidarity.
- Himalayan Stability as India’s Security Concern
- The Himalayan cryosphere is not confined within national boundaries.
- Changes in glaciers and snow cover influence the hydrology of major river systems feeding the Indo-Gangetic plains.

The Need for Himalayan Cooperation

- South Asia could explore a regional parametric catastrophe-risk insurance mechanism, drawing lessons from the Caribbean Catastrophe Risk Insurance Facility.
- Unlike conventional insurance, parametric insurance can release funds automatically when predetermined scientific thresholds, such as extreme rainfall or river discharge, are crossed.
- This can provide rapid liquidity immediately after a disaster.
- Strengthen Climate-Resilient Infrastructure
Himalayan infrastructure should incorporate:
- Glacier and avalanche hazard mapping
- Climate-adjusted design standards
- Sediment management
- Redundant power systems
- Safer hydropower siting
- Real-time structural monitoring
- Nature-based solutions
- Reform Global Climate Finance
The global Loss-and-Damage architecture needs:

Climate Change as a Geopolitical Issue
The Nepal episode demonstrates that climate change is increasingly transforming regional geopolitics.
It affects Climate, Water, Energy, Infrastructure, Finance, Migration, Security
Thus, Himalayan climate governance should not remain confined to environmental ministries. It requires coordination among:
- Foreign affairs
- Water resources
- Energy
- Disaster management
- Defence
- Finance
- Science and technology
Conclusion
Nepal’s demand for climate compensation highlights a fundamental contradiction in the global climate regime: climate vulnerability is distributed very differently from historical responsibility for emissions.
Existing international law makes direct compensation claims against specific emitters difficult, while existing Loss-and-Damage financing remains inadequate relative to the scale of disasters.
For India, the appropriate response lies neither in accepting automatic legal liability nor in treating Nepal’s concerns solely as a diplomatic issue. Instead, India should combine its advocacy of CBDR-RC at the global level with stronger climate solidarity in South Asia.
The Himalayas are a shared ecological system. Consequently, shared data, shared early warnings, resilient infrastructure, regional risk insurance and predictable climate finance should form the foundation of a new Himalayan climate partnership.
Climate justice must ultimately move from a debate over compensation towards an institutional system that prevents vulnerability from becoming irreversible development loss.
